Please read carefully this document. This is the Legal Notice that establishes the conditions of use and regulates the access, navigation, and use of the Web Site located at the URL www.registradores.org (from now on the “Web Site”).

The access, navigation, and use of the Web Site grant the visitor the condition of user (from now on, the “User”), which involves the express acceptance y without any reservation of all the terms included in this Legal Notice, which offers the same validity and effectiveness as any other written and signed contract.

As such, any individual access, navigation, and use of this Web Site must comply with the terms in this Legal Notice. If you disagree with these terms do not access, navigate, or use the Web Site.

Object and Scope of Application

This Legal Notice regulates the access, navigation, and use of the Web Site, notwithstanding the fact that CORPME reserves the right to modify its layout, configuration and content, as well as the conditions required for accessing and using the Web Site. The modifications of the terms and conditions of this Legal Notice will be published in the same manner as it is usually displayed or through any type of communication addressed to the users. The access, navigation, and use of the Web Site, once the modifications or changes become effective, involve the acceptance of them.

CORPME is established as a public law body endowed with legal personality and full capacity under the terms of the law, and recognized by the State, whose main purpose is the coordination of the professional activity of the Registrars that act in Spain, guaranteeing the correct exercise of their duties.

For this reason, and as a result of the attributions assumed by CORPME through its general Statutes, it provides, administers, and manages the Web Site in order to provide a means for exercising the duties of the registrars in an alternative and efficient manner, entailing the same effects as requesting the services through physical Registration.

The Web Site, since it was launched, offers a Web portal that provides contents and services derived from information, programs and data related to the Land Registry (from now on, the “Services”), which will have the same qualification and consideration as those directly obtained from the traditional offices.

However, the access to specific contents and the use of specific services may be subject to particular conditions that, in any case, will be clearly displayed. These particular conditions may replace, complete or, if applicable, modify the terms included in this Legal Notice. In case of conflict with other terms, the particular conditions will always prevail.

 

Customer Service

CORPME, as responsible for the Web Site and in charge of marketing the Services offered through it, establishes a Customer Service from Monday to Friday, from 09:00 to 18:00, for handling any kind of queries, complaints and suggestions related to the subscription of any of the Services.

In particular, the contact channels made available to Users are specified in the Identification section.

CORPME will answer the claims or queries received as soon as possible.

 

Intellectual and Industrial Property Rights

Rights on the Web Site and its Contents

CORPME is the owner of (or else has the corresponding licenses on) the intellectual and industrial property rights of the Web Site, as well as of all the Contents offered in it, including but not limited to, the actual platform, texts, photographs or illustrations, logos, brands, graphic designs, interfaces, or any other information or content, and the services available through it.

The access, navigation, and use of the Web Site by the User will never involve the renunciation, transmission, permission or total or partial transfer of those rights by CORPME. By accessing the Web Site, the user gains a right to use the contents and/or services of the Web Site within a domestic scope and exclusively for the purpose of receiving the service in accordance with this Legal Notice.

The references to brands or registered trademarks, or other distinctive signs, either owned by CORPME or third-parties, involve the prohibition of using them without the consent of CORPME or their legitimate owners. The access, navigation, and use of the Web Site or its contents will never grant to the User, except if expressly agreed in writing by CORPME, any right on the distinctive signs included in it.

All intellectual and industrial property rights are reserved on the Contents of the Web Site and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, make available, transform or distribute, by any means, and under any format, all or part of the contents included in it for public or commercial purposes, without the previous, express and written authorization of CORPME or, if applicable, the owner of the corresponding rights.

It is also forbidden to delete or manipulate the copyright indications or other credits identifying the owner of rights on the contents of the Web Site, as well as the technical protection devices, fingerprints, or any other mechanism for protection or information included in them.

 

Links

Links to Other Web Pages

The Web Site includes links to other web pages in the form of different buttons, links, banners, embedded contents, etc. CORPME informs that they are directly managed by third-parties. CORPME is humanly and technically incapable of knowing in advance, controlling or approving all the information, content, products or services provided by other platforms to which links from this Web Site can be established.

As a result, CORPME will not accept any responsibility for any issue related to any platform or web page to which a link from this Web Site can be established, including but not limited to, its operation, access, data, information, files, quality and reliability of the products and services, its own links and/or any of its general contents.

In this sense, if the Users had an effective knowledge that the activities developed through these third-party web pages are illegal or contravene the moral and the public order, they should immediately report this to the Provider in order to disable the access link to them.

In any case, establishing any type of link from the Web Site to an external web page will not involve that any kind of relationship, collaboration or dependency exists between CORPME and the party responsible for that external web page.

Links to the Web Site in other Platforms, Web Pages or Social Networks

CORPME can make available to the users, through different tools and applications, in particular, banners, links allowing users to access the Web Site from different pages, or even banners placed in social networks. The only purpose for adding these links is facilitating the access to the Web Site by the Users.

Establishing these links will not involve that any kind of relationship exists between CORPME and the owner, manufacturer or distributor of the platform where the link is located, nor the acceptance and approval by CORPME of the contents and services in the platforms to which they redirect. As such, the only responsible for them is their owner, manufacturer or distributor.

CORPME will never share with Facebook, Twitter or any other social network that can be added to the Web Site, any kind of personal information on its users, being its only purpose that established in this Legal Notice, and in the Privacy Policy of the Web Site. In this sense, all the information that the user may wish to provide to these platforms will be under his/her exclusive responsibility and CORPME does not intervene in that process.

The activation and use of these links may involve the identification and authentication of the user (by means of login or password) in the corresponding platforms, which are completely unconnected to the Web Site and beyond the control of CORPME. By accessing these external networks, the user enters an environment not controlled by CORPME, so it will never be responsible for the security configuration of these environments.

As CORPME does not have any control on the content placed in those channels, the user acknowledges and accepts that CORPME is not responsible for the content and the services accessed by the User in those pages, nor for any other content, products, services, publicity, or any other material available in them. For that reason, the user should be extremely careful in the assessment and use of the information, contents and services existing in the linked channels, and of his/her own information or third-party information to be shared in those channels.

 

Rules of Use

It is not permitted and, therefore, the user will be exclusively responsible for the consequences, to access or use the Web Site with illegal or unauthorised purposes, whether for economic reasons or not. In particular, the actions that are prohibited include but not limit to the following:

  • Using the Web Site in a way that may cause damages, interruptions, inefficiencies or defects in its operation or in a third-party computer;
  • Using the Web Site for the transmission, installation or publication of any virus, malicious code or other damaging programs or files;
  • Using the Web Site in a way that constitutes an infringement of the rights of CORPME or any third-party;
  • Using the Web Site for transmitting or publishing any defamatory, offensive, racist, vulgar, denigrating, pornographic, obscene or threatening material, or other which may upset any individual;
  • Using the Web Site in an illegal manner contravening the moral, good faith and public order;
  • Accessing or interacting with the Web Site using a false identity, supplanting third-parties, using a different profile or performing any other action that may create confusion on the identity of the sender of a message;
  • Accessing without authorisation any section of the Web Site, other systems or networks connected with it, any CORPME server, by means of hacking or falsification, extraction of passwords or any other unlawful means;
  • Breaching or attempting to breach the security or authentication measures of the Web Site or any network connected to it, or the security or protection measures inherent to the contents included in the Web Site;
  • Performing any action that provokes an unnecessary or disproportionate saturation in the infrastructure of the Web Site or in CORPME’s systems or networks, as well as in the systems and networks connected to the Web Site; and
  • Entering data that are clearly false, regardless of whether or not the User is aware of such circumstance.

Not complying with any of the previous obligations by the User may lead to the adoption by CORPME of the appropriate measures under the terms of the law and its own rights and duties, including deleting or blocking the account of the offending User, without the option by this one to seek compensation for the damages caused.

CORPME reserves the right to remove all those contents, contributions or comments that contravene the law, the moral and the public order, including but not limited to, those damaging the dignity of individuals, discriminatory, racists, xenophobic, pornographic, or those going against young persons or infants or the public security. In any case, CORPME will not be responsible for the opinions of the users expressed through the forums, chats or other participation channels/tools.

 

Liabilities and Guarantees

CORPME cannot guarantee the reliability, usefulness, or veracity of all the information contained in the Web Site, nor the usefulness or veracity of the documentation made available through it.

As a result, CORPME does not guarantee nor is responsible for: (i) the continuity of the contents in the Web Site; (ii) the absence of errors in those contents; (iii) the absence of virus or other harmful components in the Web Site or in the server that provides the site; (iv) the invulnerability of the Web Site or the impossibility of infringing the security measures adopted for it; (v) the lack of usefulness or performance in the contents of the Web Site; nor (vi) the damages caused to him/herself or to a third-party any individual that infringes the conditions, rules and instructions that CORPME establishes, or through the infringement of the security systems.

Nevertheless, CORPME states to have adopted all the required measures, within its possibilities and state of the art, for guaranteeing the correct operation of the Web Site and reducing system errors to the minimum, both from a technical perspective and in relation to the contents published, as well as for preventing the existence and transmission of virus and other harmful components to the computer systems of the Users.

CORPME does not guarantee the lawfulness, reliability, and usefulness of the contents provided by third-parties through the Web Site. If the User had any knowledge of the existence of any unlawful, illegal content or which may infringe the rights of third-parties, he/she must notify it immediately to the Provider, so this one can take the appropriate measures to solve it.

CORPME will not be responsible for the veracity, integrity or update of the information published in the Web Site that come from external sources, nor for the contents published in other platforms in which a banner has been placed linking it to the Web Site. CORPME will not be responsible for possible damages that may arise from using any of the alluded information. If any user of the Web Site performs any action that can be considered as unlawful, illegal or which may infringe the rights of third-parties, he/she will do so under his/her own responsibility, and the Provider will not be responsible for that action.

 

Discontinuation of the Web Site

CORPME reserves the right to discontinue, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, placement or download of the content, or the use of the services in the Web Site, with or without prior notification, to those users contravening any of the provisions detailed in this Legal Notice, and the User will not be entitled to claim any compensation because of this.

 

Confidentiality and Data Protection

In accordance with the REGULATION (EU) 2016/ 679 OF THE EUROPEAN PARLIAMENT AND THE COUNCIL, dated April 27, 2016 on the protection of physical persons in relation to the processing of personal data and the free movement of the data, and by which the Directive 95/46/EC (General Data Protection Regulation) is abolished, the processing of user data will be performed following the Privacy Policy of the Web Site.

 

General

The headers of the different clauses are merely informative, and they will not affect, rate or extend the interpretation of this Legal Notice. In addition, CORPME can modify the terms and conditions herein, totally or partially, by publishing any change in the same manner as it is displayed in this Legal Notice or through any type of communication addressed to the users.

Therefore, the validity of this Legal Notice coincides with its exposure period, until it is totally or partially modified, after which this modified Legal Notice will be the valid one.

The services made available to the Users can be altered by CORPME without prior notice. If any of the services offered includes particular conditions, they must be duly notified to the user and will have to be accepted before providing any of the services.

In addition, CORPME may terminate, discontinue or interrupt, at any moment, and without prior notice, the access to the contents of the Web Site, and the user will not be entitled to claim any compensation for it. After this termination, the prohibitions for using the contents described above in this Legal Notice will remain in place.

If any provision in this Legal Notice is declared null or inapplicable, totally or partially, by any Court or competent administrative body, that nullity or inapplicability will not affect the other provisions herein.

Not exercising any right or provision contained in this Legal Notice by CORPME will not constitute a renunciation to it.

 

Applicable Legislation and Jurisdiction

The regulation in place will determine the applicable laws and jurisdiction governing the relations between CORPME and the Users of the Web Site. However, whenever that regulation foresees the possibility for the parties to submit to a specific jurisdiction, for any dispute derived from or related to the Web Site, the Spanish legislation in place at the time of said dispute will be applicable. In addition, CORPME and the Users expressly renounce to any other jurisdiction that may apply, and submit to the Courts of Madrid (Spain).
